Background: The brace was developed and designed by an athletic trainer at the University of Notre Dame in 2016. The athletic trainer had no previous experience in designing AFO’s plus he had no experience and/or training in lower extremity biomechanics. He simply wanted to get his football players back on the field, after injury, to resume playing fast.
Ready to market: A naïve retired orthopedic surgeon take over and buys in to own and run the company. His name is Fred Ferlic, M.D. Dr. Ferlic is a retired general orthopedist with no fellowship training at all. And absolutely no additional training of any kind in the foot and ankle.
NFL football and Division I college football: A very little headway is made with certified athletic trainers (ATC) that work with these teams. The way the headway was made was by giving the braces away, at no charge, for the players to use and so the athletic trainers could evaluate the brace at this same time. The sales to NFL teams and Division I college teams were very few and far between.
Summary: At this point in time, the National Athletic Trainers Association (NATA) along with certified athletic trainers who work at a few Division I colleges has been
Dr. Ferlic’s target. As mentioned above Dr. Ferlic has given the brace away to any college and university who wanted one and then brags about how many teams he has outfitted. In the end, the ATC profession has zero influence to purchase this useless brace. Athletic trainers and physical therapists cannot bill for durable medical equipment. The orthopaedic community could care less about this useless brace. Hence, Dr. Ferlic lacks the confidence in his brace to approach the American Academy of Orthopedic Surgeons or the American Orthopedic Foot and Ankle Society. Rightfully understood, they would laugh at the brace and him.
Has TAYCO reached a dead-end ? Nope.
The next ordeal: Dr. Ferlic needs a consultant desperately. He does not know how to proceed. Dr. Patrick DeHeer, a personal friend of Dr. Fred Ferlic suggests that he hire Dr. Paul Kesselman as a consultant. Dr. Ferlic hires Dr. Kesselman. Boy oh boy, Dr. Ferlic did not realize how much money he would be spending with Dr. Kesselman. Dr. Ferlic and TAYCO run out of working capital. They now bring in private equity and outside investors.
Trying to get PDAC approvals: This goes on for 2 to 3 years. TAYCO keeps submitting applications to PDAC and gets rejected. Not once, not twice, many times over and over again. After 2 full years (Dr. Kesselman) finally gets approval on the custom version of the brace, (which is L1970). It is now time to try and get approval on the off- the-shelf version since they spent the last 2 years testing the waters on the custom version. They submit the off-the-shelf version asking for L1971. They get denied, again and again and again. PDAC tells TAYCO the brace must be taller in height to qualify for L1971 approval.
So TAYCO goes back to the drawing board and makes the brace much taller (actually to the knee). They re-submit again and the off-the shelf version is now coded L1971.
Let me emphasize ……………. This is a very tall split upright (up to the knee) attaching to the outside of the shoe.
Fraud is now involved via deceiving the provider: They only sell a short version off-the shelf brace going just above the ankle. They say that this brace is PDAC coded L1971. Clearly, it is not. They do not show the tall (off-the-shelf version) going up to the knee in height. The PDAC approved L1971 cannot be found or seen on the website as they know, no one will buy it that tall. Where are Dr. Kesselman and Dr. DeHeer while this fraud is going on?
The end is arriving: (aka dead-end) Private equity funding is allowing Dr. Fred Ferlic, M.D. to pay $10,000. to deliver an infomercial on the TAYCO external ankle brace at the Present “Treasure Hunt” virtual meeting this weekend. Dr. Kesselman made the suggestion to Dr. Ferlic to deliver this infomercial.
Podiatry here we come before the end: Dr. Ferlic has clearly identified podiatry as the low hanging fruit because the profession is gullible and jumps at fads. If this TAYCO external AFO was so great, why did it not take off with the football athletic trainers? Why the need for private equity investment?

You can knock anyone you want but when I was at Scholl, he was the only instructor who cared about the students. His Business law class and practice management class was excellent as was his class in internal medicine. Of course they had to fire him for some crazy reason probably because he was out spoken and kept telling scholl, Podiatry is going no where with out a full license.
