Dear Podiatry Post readers,

 

 

As you probably know, Jody Hackel, MD and I have been in a legal battle with my former company, Bako, that started with our inquiry into the validity of our non-competes but then unexpectedly evolved into a fight for our reputation, our ability to lecture at podiatric CMEs, and our ability to perform charitable activities in general.

 

I’m writing for two reasons. Foremost is to let you know that this week a major decision was made in one of our cases. Judge Carpenter threw out ALL of Bako’s counter-charges related to their personal allegations against Jody and I. In doing so he used terms like “childish”, “name calling”, and “has no place in my court”.

 

While this is a very positive development, we are still fighting for our right to practice medicine, teach medicine and give back to the podiatric community. This is largely because Bako swore under oath that Jody and I were not practicing physicians. They did this because Delaware does not honor noncompetes involving physicians. Thus, Bako’s sworn allegations that Jody and I were merely administrators and not physicians created “an issue of fact” that requires additional evidence to resolve. This is where I need your help. I have attached some extremely simple affidavits. #1 states that yes Jody and I made diagnoses for you and helped guide the management of your patients. #2 states that you still use Bako, but you have noticed poorer quality, and #3 says that you have stopped using Bako, and did so because of a drop in quality or the behavior of the company’s leadership.

 

We’re hoping that you’d be willing to sign #1, and if one of them applies, either #2 or #3. If you’ll be kind enough to help us, they will have to be notarized. I know it is an inconvenient, but your efforts here will help us immensely.

 

Whether or not you decide to make a statement, I sincerely appreciate your time and attention to this matter.

Nah. Seth’s a stand-up dude. It just takes a while to get the hang of it…Think of it like removing an ingrown nail from a 400lb Ritter Sitter farting and yacking on her smartphone. You know you got it when the chair creaks, falls to the side—you gotta catch her before hitting the ground.
