Yes the lawsuits are coming. First of all, patients need money. They will consciously or unconsciously be seeking a poor result or other dissatisfaction following their surgery. This will lead to more lawsuits. You must remember that no lawsuit will be filed without the opinion of a subsequent treating doctor or an expert witness. Given the fact that they are likely not doing the greatest in their practice right now they will also be more than willing to testify to pick up some money. There is no question about this either. It is interesting that some of the people most active as plaintiffs expert witnesses are from the idiotic forensic podiatry group. These people have minimal training and minimal experience in surgery but believe that because they have the certificate in so-called forensic podiatry they are now expert witnesses. These people are advertising in the magazine that plaintiff lawyers look at in order to find expert witnesses. But expert witnesses are not restricted just to this group. Another problem is the fact that with practices being slower many of our colleagues are pushing the indications for surgery. When things go badly the initiation of surgery for problems that could’ve been treated without surgery becomes more obvious. This is particularly a problem with all the “three-year surgeons” and fellowship trained “surgeons” that we are now turning out. They only know how to do surgery. They only see surgery as an answer to every problem. Have a callous? Osteotomy. Have a flat foot? Surgery. Have a bunion? Surgery. Also, podiatry is taking on more complex patients such as diabetic patients and patients with vascular disease. Some of these are simply not going to work out and the patients and their families will sue for malpractice. This is reality. It’s not easy to sue an orthopedic surgeon because they have a sense of collegiality. Podiatrists do not share the same sense and will eat each other in a moments notice, when the water dries up and the food chain is starting to become limited.
